Terms of Service

Please read these Terms of Service ("Terms") carefully before using the SafeCheck mobile application ("App") operated by SafeCheck ("we", "us", or "our").

1. Acceptance of Terms

By downloading, installing, or using SafeCheck, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

SafeCheck provides:

• Safety check-in notifications to your personal contacts
• Emergency alert functionality to notify your designated contacts
• Location sharing (only when you manually trigger an emergency alert)
• Contact management features

3. Not an Emergency Service

You expressly acknowledge and agree that:

• SafeCheck does not dispatch emergency responders
• Alerts are sent to your personal contacts only, not to authorities
• Message delivery depends on network connectivity and is not guaranteed
• Push notifications may be delayed or fail due to device settings, network issues, or other factors outside our control
• Your contacts may not see or respond to alerts immediately

4. No Guarantee of Service

We strive to provide reliable service but cannot guarantee:

• Continuous, uninterrupted availability of the App
• Delivery of any notification or alert
• Accuracy of location data
• Response from your contacts
• That the App will meet your specific requirements

5. User Responsibilities

You agree to:

• Provide accurate contact information
• Inform your contacts that they are added to your SafeCheck network
• Not rely solely on SafeCheck for emergency situations
• Maintain alternative means of communication for emergencies
• Keep your device charged and connected to send alerts
• Not use the App for false alerts, harassment, or illegal purposes

6. Subscription and Payments

SafeCheck offers free and premium subscription tiers:

• Free Tier: Basic features with limitations on contacts and history
• Premium Tier: Unlimited contacts, extended history, and additional features

Emergency alert functionality is available to ALL users regardless of subscription status. We will never restrict safety-critical features behind a paywall.

Subscriptions are billed through Google Play and are subject to Google's terms and refund policies.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• SafeCheck and its developers, officers, employees, and agents shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages
• This includes but is not limited to: personal injury, loss of life, emotional distress, property damage, loss of data, or any other damages arising from:
  • Your use or inability to use the App
  • Failure of alerts to be sent or received
  • Delayed notifications
  • Inaccurate location data
  • Actions or inactions of your contacts
  • Service interruptions or outages
  • Any other matter relating to the App

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App is free of viruses or harmful components
• The results of using the App will meet your requirements

9. Indemnification

You agree to indemnify, defend, and hold harmless SafeCheck and its developers from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the App or violation of these Terms.

10. Account Termination

We reserve the right to terminate or suspend your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the service (false alerts, harassment)

11. Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Philippines, without regard to conflict of law principles.
